Terms of Service

Chapter 1 General Provisions

Article 1 (Purpose)

The purpose of these Terms is to set out the conditions and procedures for using the information and services provided by IMPIX Co., Ltd. (the “Company”) through the Company website (https://www.impix.co.kr, the “Website”), together with other necessary matters.

Article 2 (Definitions)

The terms used in these Terms have the following meanings.

  1. “Website” means the internet site operated by the Company to provide information about the Company and its products and services.

  2. “User” means any person who accesses the Website and uses the information and services it provides under these Terms.

  3. “Content” means all text, images, diagrams, video, documents, design, software and compilations thereof published on the Website.

  4. “Enquiry” means a communication sent to the Company by a User through the Website’s enquiry form or a contact point published by the Company.

Article 3 (Publication and Amendment of these Terms)

  1. The Company publishes these Terms on the Website so that Users can review them.

  2. The Company may amend these Terms to the extent that it does not breach the applicable legislation.

  3. Where the Company amends these Terms, it shall give notice on the Website from 7 days before the effective date, stating the effective date and the reason for the amendment. Where the amendment is disadvantageous to Users, notice shall be given from 30 days before the effective date.

  4. A User who continues to use the Website after the effective date of amended Terms is deemed to have agreed to them. A User who does not agree to the amendment may discontinue use of the Website.

Article 4 (Rules Other Than These Terms)

Matters not provided for in these Terms are governed by the applicable legislation and commercial practice.

Chapter 2 Use of the Service

Article 5 (Content of the Service)

  1. The Website principally provides information about the Company and its products, solutions, case studies and press coverage, and receives enquiries from Users.

  2. Use of the Website requires no membership registration or login, and no fee is charged.

  3. The Company may change the content, structure and scope of the service as required for business or technical reasons.

Article 6 (Service Hours)

  1. As a matter of principle, the Website is provided 24 hours a day, every day of the year.

  2. The Company may, however, suspend all or part of the service in any of the following cases, and shall give notice in advance. Where there are unavoidable circumstances that make advance notice impracticable, notice may be given afterwards.

    • Where maintenance, inspection or replacement of facilities, or system improvement, is required

    • Where normal provision is difficult due to a power failure, loss of communications, equipment failure, a surge in use or similar

    • Where a failure or suspension occurs in an external service used by the Company (hosting, domain, mail delivery and so on)

    • Where there is a natural disaster, national emergency or other comparable event of force majeure

Article 7 (Receipt and Handling of Enquiries)

  1. An enquiry sent by a User is deemed to have arrived when the Company receives it.

  2. Receipt of an enquiry is neither an offer nor an acceptance of a contract, and gives rise to no contractual rights or obligations between the Company and the User. Specific terms of business are settled by separate agreement.

  3. The Company determines at its own discretion whether and when to reply to an enquiry it has received.

  4. The Company’s Privacy Policy applies to the handling of personal information collected through enquiries.

Chapter 3 Obligations of Users

Article 8 (Prohibited Acts)

When using the Website, a User shall not engage in any of the following acts.

  1. Interfering with the normal operation of the Website

  2. Infringing the copyright, trademark rights or other intellectual property rights of the Company or a third party

  3. Damaging the reputation of, or interfering with the business of, the Company or a third party

  4. Using Content for commercial purposes, or providing it to a third party, without the Company’s prior written consent

  5. Building Content into a commercial database, or redistributing it for a fee, without the Company’s prior written consent

  6. Circumventing the Website’s security settings or attempting to access unauthorised areas

  7. Sending an enquiry containing false information, or using the enquiry form for advertising or spam

  8. Impersonating an officer or employee of the Company, or forging or misappropriating the Company’s name, business cards or logo — for example to demand money from a third party — and thereby damaging the Company’s standing

  9. Any other act in breach of the applicable legislation

Article 9 (Automated Access)

  1. Collection and indexing of the Website by the crawlers of search engines and artificial intelligence services is permitted within the scope set out in the robots.txt published by the Company.

  2. Notwithstanding paragraph 1, automated access that places an excessive load on the server, and collection of areas not permitted by robots.txt, are prohibited.

  3. Where the Company judges that automated access is impeding the operation of the Website, it may block that access.

Chapter 4 Intellectual Property

Article 10 (Ownership of Content)

  1. Copyright and other intellectual property rights in the Content of the Website belong to the Company. Rights in Content licensed from a third party, however, belong to the rights holder concerned.

  2. Rights in “임픽스”, “IMPIX”, “A²LAB”, “B²LAB”, “A²”, “L²”, “V²”, “A.Station”, “A.ESG” and comparable names, trade names, trademarks, service marks and logos of the Company belong to the Company, and Users may not use them without the Company’s prior written consent.

Article 11 (Quotation and Use of Content)

  1. A User may quote Content within a justifiable scope, with attribution, for purposes such as reporting, criticism, education or research.

  2. Collection of the Website’s Content by search engines and artificial intelligence services, and quotation of it in search results or answers together with attribution, is permitted under paragraph 1.

  3. Reproduction, distribution, transmission, display, creation of derivative works and commercial use beyond the scope of paragraphs 1 and 2 require the Company’s prior written consent.

  4. Client names, logos and the contents of case studies also involve the rights of the clients concerned; when quoting them, the rights of both the Company and the client concerned shall be respected.

Chapter 5 Disclaimers and Limitation of Liability

Article 12 (Accuracy of Information)

  1. The Company endeavours to keep the information published on the Website accurate.

  2. Information on the Website is, however, prepared as at the time of publication, and may differ from current fact as circumstances change or technology advances. The Company does not warrant the completeness, accuracy, currency or fitness for a particular purpose of the information.

  3. The Company may amend or delete information on the Website without prior notice.

Article 13 (Notice Concerning Case Studies and Performance Figures)

  1. The case studies and performance figures published on the Website are results obtained in the specific equipment, process and data environment of a specific client.

  2. The figures under paragraph 1 do not warrant that the same or similar results will be reproduced in another environment, and are not a representation promising future performance.

  3. The actual performance of a solution provided by the Company varies with the characteristics of the target process, the volume and quality of data that can be collected, the configuration of existing systems, operating arrangements and other factors.

  4. A User shall not make investment, purchasing or other decisions on the basis of the information on the Website alone; any specific adoption review shall be conducted through individual discussion with the Company.

Article 14 (External Links)

  1. The Website may provide links to sites operated by third parties for the convenience of Users.

  2. The Company is not involved in the content, operation or reliability of linked sites and bears no liability for any damage arising from them.

Article 15 (Disclaimer)

  1. The Company bears no liability for damage arising from any of the following.

    • A natural disaster, national emergency or other comparable event of force majeure

    • A failure or damage attributable to the User

    • Suspension of or failure in a service provided by a third party, such as a key telecommunications business operator or a hosting provider

    • The outcome of a decision made by a User in reliance on information on the Website

    • A dispute arising between Users, or between a User and a third party, by way of the Website

  2. The Company bears no liability for indirect, special or consequential damage incurred by a User in connection with use of the Website, including lost profits, lost business opportunity and loss of data.

  3. Paragraphs 1 and 2 do not apply where there is wilful misconduct or gross negligence on the part of the Company, or where the applicable legislation provides otherwise.

Article 16 (Limitation of Liability)

To the extent permitted by the applicable legislation, the total amount of damages the Company owes a User in connection with use of the Website is limited to the amount the User actually paid to the Company under the transaction that was the direct cause of the damage. Because the Website is provided free of charge, no liability to pay damages arises on the part of the Company where there has been no separate paid transaction. This does not apply, however, where there is wilful misconduct or gross negligence on the part of the Company.

Chapter 6 Miscellaneous

Article 17 (Protection of Personal Information)

The Company protects Users’ personal information in accordance with the applicable legislation. Specific matters — the items collected, the purpose of use, the retention period and Users’ rights — are governed by the Privacy Policy published on the Website.

Article 18 (Governing Law)

These Terms and use of the Website are governed by the laws of the Republic of Korea.

Article 19 (Jurisdiction)

  1. The Company and Users shall make the necessary efforts to resolve amicably any dispute arising in connection with use of the Website.

  2. Where a dispute is not resolved despite the efforts under paragraph 1, any lawsuit shall be brought before the court having jurisdiction under the Civil Procedure Act.

  2. These Terms supersede the previous terms upon taking effect.
